Terms of Service

These Terms of Service ("Terms") govern your use of cafe-pricing.com (the "Site"), operated by Diego Duron Tepichin, an individual based in Mexico ("we", "us"). By using the Site or initiating a purchase through it, you agree to these Terms.

These Terms cover the Site itself. The software license you receive after purchase is governed separately by the CAFE End User License Agreement, available at checkout and at the download/checkin endpoint of the software backend — not by this page.

The Site is a marketing and checkout page for CAFE, a dynamic pricing engine licensed as a one-time, perpetual, hardware-bound commercial software package across three tiers (Core, Professional, Enterprise). Purchases are processed by Paddle.com (paddle.com), which acts as merchant of record: the sale contract for the software license is between you and Paddle/us as applicable under Paddle's own terms, available at paddle.com/legal.

All content on the Site — text, design, graphics, the CAFE name and logo — is owned by us or our licensors and protected by applicable intellectual property law. Purchasing a software license does not grant you any rights to the Site's own content beyond normal browsing use.

The CAFE software itself, once purchased, is licensed (not sold) under the terms of the separate End User License Agreement referenced in Section 1 — including restrictions on redistribution, reverse engineering, and the number of permitted hardware re-bindings.

You agree not to: misuse the Site in a way that could damage, disable, or impair it; attempt to gain unauthorized access to any part of the Site or backend systems; use the Site to submit false or fraudulent checkout information; or use the Site for any unlawful purpose.

Prices shown on the Site are in USD and may change at any time without notice; the price in effect at the time you complete checkout applies. Payment, invoicing, and applicable tax (e.g. VAT) are handled by Paddle as merchant of record.

Refunds are governed by our Refund Policy, available at /refund-policy.

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or secure.

Warranties (if any) regarding the CAFE software itself are governed exclusively by the End User License Agreement, not by these Terms.

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, even if advised of the possibility of such damages. Our total liability arising from or related to the Site shall not exceed the amount you paid, if any, for access to the Site itself (as distinct from the software license, which is governed by its own agreement and by Paddle's terms).

These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be subject to the competent courts of Mexico, except where applicable consumer-protection law in your jurisdiction grants you the right to bring a claim elsewhere and such right cannot be waived.

Disputes relating specifically to a payment transaction processed by Paddle may also be subject to Paddle's own terms and dispute-resolution process.

We may revise these Terms from time to time; the "Last updated" date above reflects the latest revision. Continued use of the Site after a change constitutes acceptance of the revised Terms.
